PARTICULATE WARRANTY
Seller warrants the baghouse, to meet .04 grains
per standard cubic foot) on particulate over two microns on the equipment being
properly installed and maintained.
This warranty will be in effect for eighteen (18) months from the plant shipment
date and the plant shipment date will be no later than 14 days from Tender of
Delivery date and the Buyer will have installed bags as needed to maintain the
baghouse. Condensibles are not to be
considered in the grain loading.
Effluent testing will be in accordance with Title 40, Part 60 of the Code of
Federal Regulations. The Buyer's
sole and exclusive remedy for breach of any warranty or any other obligation of
Seller related to the sale of equipment hereunder shall be the right to require
the Seller to repair or replace the defective equipment. Buyer will pay the cost of
disassembling and returning any defective equipment to a place to be designated
by the Seller for such repair or replacement.
In the event that repair or replacement fails of its essential purpose
and after the Seller is given a reasonable opportunity to cure, then the Buyers
sole and exclusive remedy shall be the right to recover the amount paid to the
Seller for the defective equipment, less any prior warranty allowance given and
the reasonable value of any use made of the equipment by the Buyer. (See Section 8. Limitations of
Remedies). The Buyer may hire the
Seller to perform a service inspection of the baghouse before a stack test is
made. Please contact the Buyer at
least two weeks ahead of the stack test for scheduling service.
SCRUBBER WARRANTY
Seller warrants the soil Remediation scrubber to
meet the following pollution control requirements, when erected and operated
according to the Seller's instructions.
This unit will remove 95% SOX from the Tarmac International, Inc.'s 1.4 M
diameter (4.5' diameter) soil remediation plant baghouse stack gas parameters
of: 8,000 ACFM gas @ 1650C (3250 F), 1.6 kg (7 pounds) per
hour of SOX, 7.5 1iters (2 GPM) fresh water make-up, and the required addition
of HCL or H2SO4 . This warranty will be in for eighteen
(18) months from the plant shipment date and the plant shipment date will be no
later than 14 days from Tender of Delivery date.
